Many of the trucks you see on the roads today are insured on one of three commercial auto insurance contracts: the truckers form, the motor carrier form or the business auto form. The truckers form is used for firms hauling only goods owned by others. The motor carrier form insures firms hauling both their own goods and the goods of others. The business auto form is used to cover firms hauling only goods that they own. The Insurance Services Office, Inc. (ISO), promulgates all three contracts. We will discuss the exclusions under the business auto policy and how to provide coverage for the excluded risks. To do so, we will consider several examples. In a fictitious example, MBF Corp.s (MBF) annual planning conference was going to be held at a mountain lodge. Conference attendees from all over the country would need to fly into a nearby town, rent four-wheel drive vehicles and drive about 20 miles to the lodge. The last five miles of the route required four-wheel drive vehicles because there was no pavement, only a trail created by vehicles driving over the mountain terrain. In spots, this trail was steep and in other places it was steeply slanted to one side or the other.

Kathleen M. Tomlin was recently elected director, Western Region, to the National Board of Directors of the National Association of Credit Management (NACM). Tomlin is an associate with Q2C Quote to Cash Process Consulting. Formerly, she was regional credit manager for Hanson Aggregates Mid-Pacific and Hanson Permanente Cement. Rodent control is taking some interesting and not so encouraging turns. There is an initiative that will be introduced in California on the November 1998 ballot (assuming it gets the 500,000 signatures needed, which is a slam dunk in California). It is called an Initiative to Ban Cruel Traps. This initiative, in a nutshell, will make it illegal to use a body gripping trap. one that grips the mammals body or body part, including, but not limited to, steel-jawed leghold traps, padded-jaw leghold traps, Conibear traps, and snares. This initiative also states that, it is illegal for any person, including employees of the federal, state, county or municipal government, to use or authorize the use of any steel-jawed leghold trap, padded or otherwise, to capture any game mammal, fur-bearing mammal, non-game mammal, protected mammal, or any dog or cat.Now, stop and reread that paragraph and think about it for a minute. This initiative decides for us that we cant control agricultural fur-bearing pests any longer. For that matter, it specifically states that you cant trap anything that has fur on it for any reason, and that the U.S. Fish Wildlife Service, State Department of Fish Game and your local county ag commissioner or county trapper cant do it either. It does make provision for the protection of human health and safety (pretty considerate - you know how vicious those gopher and mole attacks on children have been lately), and it will allow you to use mouse traps in your basement. Oh, and by the way, it introduces two chemicals that can no longer by used - Compound 1080 and sodium cyanide. What are these used for? Well, its not rodent control. The state has been experimenting with these two chemicals for coyote control. They make a collar to put around a lambs neck. If the animal is unfortunate enough to be a victim of a coyote attack and the coyote punctures the collar its lights out for the sheep killer. The point here is precedent - get these two and then work your way on to household chemicals for insect and rodent control and sweep everything up in between.Since this is not a political editorial, all I can say is watch out for this one. Agriculture will lose big time, so tell a friend and lets make sure that we dont get tied down by bad law written by extremists. I think it is very important that we dont make our decision based on whats on TV. Hollywood is anti-trapping and they have a lot of money to spend to support their position. If you want a recent case history lesson you may look at the fine State of Colorado, which had a similar initiative pass last year by a 51% margin. After the smoke cleared, it was disclosed that Hollywood spent just a little over a quarter million dollars to promote the initiative. All the local state and county representatives, combined with the agriculture and fur trapping industries, could muster was $48,000, and they lost.

Hotels around the country are spending millions of dollars participating in trade shows at conventions all over the world. The objective is to bring more business to the properties. Exhibiting at these happenings is a good idea, and an important part of a marketing plan, but are we maximizing our potential when we go to them? The way to be more productive in this type of promotion is to start with a plan. One should start with the idea of researching the event to determine to what extent the attendees would be or could be business prospects for the property. Then gather information relative to previous events attendance. Here you are looking at numbers of buyers only, not combined figures for buyers, suppliers, speakers, guests, media and others. You should also check out the ratio of buyers to exhibitors to make sure there will be enough floor action to justify the trip. Once the research is done, and you have decided to participate, plan on the number of your hotel staff who should attend. This has a lot to do with the length of the show. You probably do not want anyone working a booth longer than three hours at a shot without a break (some of these shows go on all day).

Providing that the economy stays strong, with inflation and unemployment low, the prospects for Generation Y to remain aggressive apparel shoppers remain excellent. Of an estimated $140 billion spent by kids in the 12 to 19 age group last year, more than one-third, about $46.7 billion, was spent on apparel, exclusive of another $14 billion spent on health and beauty care, according to research by Teen Research Unlimited and Channel One. The pattern of teen sales is ubiquitous within all tiers of retailing. Juniors and young mens departments are among the strongest at department stores and specialty chains. Retailers, such as Abercrombie Fitch, The Buckle, Wet Seal, Pacific Sunwear and Urban Outfitters, are registering some of the strongest overall and comp store sales increases of any apparel outlets. Will it be long before its the mass markets turn?
Maximizing the productivity of Kmarts core assets is a critical component to Chuck Conaways master plan to take the company to new levels of performance. And nowhere does Kmart stand to benefit more from its assets than in apparel, where both the executives and the brands are among the best things going for the chain. In January, Nagler was named senior vp and gmm in a realignment that eliminated a level of management in the apparel sector. Naglers elevation to the top apparel post was consistent with other changes within Kmarts executive suite that have emphasized the establishment of clearer spheres of accountability and a simpler delineation of responsibility. Nagler, who was once responsible solely for childrens wear, oversaw the successful development of Sesame Street in this segment, and later the expansion of the Route 66 brand in mens. Additionally, she supervised the expansion of the big mens program at Kmart, a program slated for greater emphasis going forward. Also, since she had past experience in womens–including stints at Federated Department Stores and The Limited–she was an eminently reasonable choice to head up Kmarts overall apparel operation.

Monday May 5, 2003 will go down in history as a day to remember in employment law. It was the day the long-debated amendments to the Health Safety in Employment Act finally came into effect. Why is this new legislation so important? The term “workplace stress” took on a whole new significance, with new obligations for employers, and potentially serious financial consequences for those who ignore them. Workplace stress is no longer simply a sad fact of life. It is now an officially recognised and legislated “workplace hazard”, with the amendments extending the definitions of “harm” and “hazard” to include physical and mental harm caused by work-related stress. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

The guitar was ordered at 4 p.m. May 3 from a man who called Midwestern Music, 5224 S.W. 17th, and wanted to buy his son a guitar, Topeka police Detective Terry Symonds said Thursday. The caller gave the store clerk a credit card number that appeared to be valid and said that his daughter would arrive later that day to obtain the guitar.

Rieter Sells Cabling, Twisting and Texturing Machine Business Rieter has sold its business in cabling, twisting and texturing machines to Co-Martin of France retroactive from October 31, 2006. The new owners have many years of experience in the man-made fiber business, and are taking over all activities at the location in Valence, France. Both sides agreed not to disclose the selling price. After careful examination of all possible options, the Board of Directors and Group Management decided to sell subsidiary Rieter Textile Machinery France SAS in Valence with all three business fields to Co-Martin. The Rieter subsidiary in Valence employs 153 persons, and achieved a turnover of approximately 50 million euro in 2005.

Dennison, who starts Monday, comes to The Capital-Journal from The Sun Herald, of Gulfport, Miss., where she was circulation retention and marketing manager. The court here said that Congresss purpose in enacting the ADA was to achieve economic deregulation of the airline industry. The purpose of the statutes preemption clause is to avoid interference with that deregulation. Nothing in the statutes language or its legislative history indicates that Congresss purpose was to displace state tort law in actions that do not affect deregulation in more than a peripheral manner, the court said. As further support, the court noted the ADA still requires airlines to maintain insurance to pay for bodily injuries to or the death of any person for which they may become liable.

After completing the acquisition of three commercial printing companies at the end of April, Teldon International became one of the largest printers in lower mainland British Columbia. This current success is ironic because when the company was founded in 1969, and for close to 20 years after, it didnt own a single press.In the 1980s, Teldons management began researching the printing industry. “We decided that a large part of our program was on printed paper, like calendars. New Texas laws give rural landowners greater liability protection when recreational guests are hunting, fishing or enjoying outdoor activities on their land. Judon Fambrough, attorney with the Real Estate Center at Texas AM University, says the new liability laws may encourage more nature tourism, a trend that is growing in popularity throughout the state. “A landowner may be more inclined to lease his or her hunting cabin to recreational visitors all year-round now that there is less worry about liability,” Fambrough says.

SAINSBURYS are launching a new clothes range - made from its shoppers rubbish. The retail giant will crush plastic collected from bins outside its 500 UK stores and turn it into dresses, suits and trousers. Sold under the stores Tu fashion range, the waste fabric will feel like polyester or viscose. Tu marketing manager Josie Cartridge said: “We hope our customers will pop their plastics into the bins outside the shop and then come back and buy it in clothes form.”
Amid all the glitz, glamour and endless hype of London Fashion Week, which ended yesterday, there have been clothes for real women that will make their way into the shops this autumn. Many of the clothes - particularly the more extravagant items designed to catch the eyes of the photographers - do not make it on to shop rails. Between now and autumn an intricate series of events will determine what will be “the fashion”, and what will not. Rita Britton, from designer emporium Pollyanna in Barnsley, was in London all week buying the clothes her working customers in Yorkshire will want. “What people who read fashion pages dont realise is that half the clothes shown dont even go into production.” A typical fashion show will have between 300 and 1,000 guests. Half of the guests will be press, and will either write about the clothes, or use them in fashion shoots. These people will determine The Trends. The other half of the audience will be fashion buyers from stores all over the world, who determine what we actually buy by shaping The Trends into real clothes. Buyers are the designers bread and butter. Without them, clothing like McQueens and Rochas, for example, would remain a fantasy. As well as these two designers, Lynette White, fashion buyer for Liberty, is responsible for buying Hussein Chalayan and Helmut Lang. For her, the catwalk presentation is incidental, the real decisions will be made in the showroom. “The amount we buy from a particular designer depends on their performance last year, and we only take risks with new designers if they are exceptional,” she said. When a buyer selects clothing it must be wearable and sellable, but not necessarily commercial. You will not find an Alexander McQueen dress in the shops that consists of just a collar with tassles to cover the breasts. Nor will you find a fuscia pink faux snakeskin jacket by Antonio Berardi. However, McQueen bumster trousers have sold at Liberty, as have intricate coats by Yohji Yamamoto. Lynette White said: “We dont aim to buy watered down fashion that people will easily understand, our aim is to educate the customer, to give them the ideas and opportunities to wear exciting clothes.” Rocha admitted that he was not a good salesman, but with his annual turnover now approaching pounds 5m and selling to 20 countries, he has hit on a formula. ” My designs come from the heart, and fortunately the buying public understands what Im trying to say.” He knows that what he does essentially is to “put clothes on backs”. McQueens clothes are aimed at a different customer, so Lynette White takes a different approach. You will not see McQueen g-string denim shorts or peak-shouldered breast-baring garments like the ones shown on Thursday in Liberty. She will be buying McQueens belted cowhide coats, cut-out leather dresses, skin-tight jeans and sharply embroidered suits. “Things are going more and more `streety,” she said. “McQueens show was a breath of fresh air, and proved that its not important to have the essential black tailored suit anymore. That is not what people want from McQueen.” So, next time you see a model on the catwalk wearing a seemingly unwearable outfit, remember, there is an army of people out there whose sole aim is to translate what they see on the catwalk into something you can wear, and that is true purpose of London Fashion Week, despite all the hype.
